My case is straightforward— the firm has sent the necessary letter, and we are waiting for a response to the deposition (the defense) before proceeding to court for a slip-and-fall case. Since state statutes allow up to two years before a court appearance becomes necessary, it appears the opposing party may be delaying in an attempt to mitigate damages or wait for external factors to impact the case.
