1 /5 S Mark (MarkkraM Marketing): I Am not pleased at all by the service of Public Defender nor paid defense lawyer. I guess the fact that Herb runs for States Attorneys office and loses should be a sign.
Herb failed to stand up and defend a 5th grader on burglary charges when being appointed as a Public Defender due to conflict of interest. How so? The parents figued out who robbed a house two doors down on the Friday following a burglary sometime that week simply by asking the kids in the neighborhood questions and by doing so a fifth grader who was blamed by the culprits and questioned by authorities at school, with permission at first due to the sureity of him not being involved, but then after the treatment by the authorities. I as the parent reached out to the authorities and was dismissed and told "that isnt the way we handle THAT" and the child was questioned a second day. Since learning from the parents investigation who did the burglary the child was pushed harder by the authorities to the point he gave them what they wanted to hear, a confession. Hearing this i questioned my son , why? And came up with 2 pages of coercion, from a fifth grader. So that was all on the authorities and school.
Now enter the public defender appointed to the child due to the Public Defender office representing the real criminal who pointed fingers at my son along with his other accomplices, Mr. HERB Schultz.
What entailed next after giving Mr Schultz a list of witneses and the two pages of coercion used by the city of East Moline PD, on a fifth grader mind you, was absolutely ZERO phone calls to witnesses, six months of showing up in juvenile court and a stagement from Mr. SCHULTZ on the day of trial from the parents when called and asked "what was his defense?"...."I take offense to that Im a damn good attorney". After telling Mr Schultz Im a damn good parent and im standing by my child and expected some service over the last six month from him and he failed, Mr. SCHULTZ asked if "we still wanted him as his lawyer". After telling Mr. Schultz we would see him in court that day and hung up, Mr. Schultz called back and apologized and then the charges were said to be dropped, but still required another court date....
Seven months of zero representation.
As a lawyer representing as a paid attorney turned Federal paid public defender for an adult son Mr. SCHULTZ did not discuss the almost 18nmonths ongoing case with family, he did not visit client in the County Jail as requested on numerous times, he did not speak truthfully and the sentencing for federsl time, he did not respond to or visit as requested before appeal date client in jail.
Simply put, one of my worst choices as defense lawyer one could make.
