It took a grueling 6 months to force the other side into mediation once we started pursuing it.
My lawyer and I had no expectation that this case could be successfully resolved in mandatory mediation. We were basically preparing for trial with the goal of getting an impasse quick and efficiently.
My lawyer, Paul Darby, fought to have Tim Keough appointed as the mediator due to his good reputation for not wasting peoples time and money if a case is obviously unlikely to settle.
To me and my lawyers surprise, Tim was able to pretty quickly steer things in a direction where settlement became a possibility and then eventually the reality.
We ended up with an outcome that is probably extremely close to how a trial would have resulted - but saving me probably an entire additional year of stress and uncertainty and more back-breaking legal costs that take years to recover from.
Im extremely grateful that Tim dug his heels in and committed to getting the case settle. I was impressed by how seriously he took the matter and he remained determined throughout day.
