5 /5 Richard Incrocci: I came to work with Attorney Eric Schweitzer through a referral from another firm in Fresno. The nature of my case, in other Attorneys opinions was not only unwinnable, but many barely looked at the documents or assumed there was a particular statute (1203.4 - which does not restore firearms possession) in play and therefore declined to even look into the matter for me stating my firearms rights would only be reinstated with a pardon. Obviously, I disagreed. Please note, I have been fighting this issue with the CADOJ and the FBI since 2019 when I was originally denied a firearm purchase. The original dismissal dates back to 1997.
When I contacted Eric, he requested copies of all of my documents, scheduled a zoom call (I live in MI) to review everything and talk with me. On our call, which by the way, he took time to do on a Saturday because of my work schedule and three-hour time difference; something I appreciated immensely. Within five minutes of reviewing my documents, he realized (with a rather excited exclamation) this was a PC1385 dismissal. Eric had stated that this would be an easy fix (and the fee to handle this was more than reasonable. I was expecting it to be more than what was stated. BONUS). Eric stated that all that was needed was to file a motion to correct the original dismissal (the original clerk didnt mark the box "dismissed in the furtherance of justice") in 1997 to reflect it was dismissed pursuant to PC1385 (which restores all firearms rights). While my presence in CA was not needed, I chose to go and be present for the hearing. On the court date, Eric and I met at the courthouse, chatted about the case and what to expect. Erics confidence, knowledge of the law, and explanation of his relationship with the court presiding Judge was very reassuring, especially with the angst I was experiencing at the time. Our case was called, a couple of minutes of conversation with the Judge to make sure we were all on the same page, then my motion was granted. Furthermore, due to the nature of the motion written by Eric, the Judge not only stated that all of my civil rights were fully restored, he went one step further and said this includes the right to own and possess firearms, effective **-**-1997, the date of the original dismissal. A thousand pound weight instantly fell off. Moreover, a sense of elation and respect for the Judge was experienced when he made it clear all civil rights were restored. This was again due because of the motion that was drafted by Eric. I was highly impressed with how thorough and concise the motion was when I received a copy.
Eric is an Attorney who epitomizes walking softly and carrying a big stick. He knows what he is doing and is obviously very good at what he does. Eric is forthright, plays no games, nor engages in any deception. Hes matter of fact, confident, as noted, and, very thorough, also as noted.
I cannot begin to close without mentioning Erics staff, Angel and Laticia. What incredible women they are. They are the heroes in the background that make everything run like a well-oiled machine. Angel and Laticia were not only very helpful with any questions I had, they were also very understanding of the angst and anxiety I was experiencing throughout this process. Their responses to emails and or returning of phone calls was much faster and much more thorough than expected. Thank you, ladies.
So, in closing, whatever legal issue you may be experiencing, especially civil rights restoration, Eric and his team will take exceptional care of you.
